Well after a eventful week at work I have been forced to resign so I start December jobless, but I'm remaining positive and looking at it like I have some time off work to get a few things done on my cars which I hadn't had time to do, but I have major can't be ***** syndrome!!! What helps people get motivated ?

Well it all started 2 months back, and we had Asian lad started working with us , and All seemed good untill a week ago, when another guy I worked with started saying racial things to him and he asked me if Id stick up for him in court, I said Im happy to write a statement but I won't go to court with it I don't want to be apart of any of that, and since then he turned sour, now I thought this guy was a friend so I told him with i thought of a guy I worked with "the one that said the racial things" and I don't like him in fact I hate the guy he belittles you and takes the ****, basically a school bully and this Asian lad told this other guy all this and since then they sorta teamed up against me, Friday I got called into the office and told I have been inciting racism and I have been stealing from the company and I have been trying to get the other guy sacked from his job, and my boss said to me he wants me to leave on my own accord or other wise he will sack me and it will be a police matter in which he said he will prosecute me, now I haven't stolen anything but the other two will make up some story to make my guilty and I really don't need the stress of proving my self, so yeah just goes to show you can't trust anyone

Hi,

Can he sack you without a writen warning? What sort of reference is he going to give you? Do you know anybody who could ask for a reference,pretending to be a potential employer. I believe a bad reference can be regarded as libel. Google that.

Out of curiosity, if anybody knows, just what would the police have done, seeing is this is the first anybody has heard of your racial attitude?

I'd be down my solicitor for freebie advice. Constructive dismissal?

On one hand it is the right decision to go, do you really want to work in an environment where there is all this tension, do you trust the rest of the workforce not to stitch you up? Are you happy having to watch your back every moment of every day?

If you move on, you move on with the rest of your life. While Ged might be technically correct, to stay and fight will result in your life being on standby while this saga unfolds.

References? Normally they are not worth the paper they are written on. A lot of firms especially where there is a high staff turnover will only write “John Smith was employed by this company from date to date”.

What would the Police have done? They would have followed this up, they have the accusation, the victim, the aggressor, witnesses. It would have been an easy score.

You can be sacked without a warning, but it has to be something serious - "gross misconduct" is a favorite, but they will have to have a watertight, evidence based case against you.

I certainly wouldn't resign at this stage - get some advise - CAB used to be good, but i don't know what they're like now. They will advise your best course of action.

If you've already resigned you can still claim "constructive dismissal" against your ex-boss. This applies if you feel you had no option but to resign.

It is not easy for a boss to just sack employees, & most firms quake at the thought of a tribunal Wink

Another vote for 'constructive dismissal'.

As an employer I can tell you that if procedures are not followed to the letter then the ambulance chasers will have a field day. Basically unless they have a watertight case you can claim constructive dismissal, threaten them with a tribunal and mucho adverse publicity and it is cheaper for them to hand you a large cheque than go through the pain of legal action. This is especially true when the guy actually said to you "I want you to quit rather than get sacked".

This kind of stuff makes me really angry and, if I assume you don't want your job back, you can get looking for work knowing you will either muck them up for months and possibly get a decent pay off at least equivalent to your lost wages/notice period and at best get a new better job AND a cash bundle.

You've got 2 or 3 years to make a claim but I'd get it started immediately.

Get angry, that'll help the motivation.

Wow didn't even think I could fight it?, no your right I don't want to i back, it's no fun being in a workshop where no one talks to you and you have to lock your tool box every time you turn your back becuase you worry somone will take something, start the job hunt today, and you all think it's worth going further with it?

Anyone here looking for a skilled mechanic?

It'll cost you nothing to speak to a decent lawyer (or an indecent one for that matter!). They're the ones who can tell you if you have a case.

Hi,

Most solicitors will give you a 30 minute chat for free. ... check yellow pages for Employment specialists. A divorce lawyer won't know much employment law. Ideally, you want a "no win no fee deal" (might concentrate their minds)

I would consider threatening you with the police is worse than sacking you. I assume that you have had no verbal (but still on file), or written warnings for the alleged offence.

How will you reply if a potential employer asks "Why did you leave?" Telling him you are suing your last boss will not go down well.

On the other hand, Shinyass at Job Centre is going to ask why you have made yourself voluntarily unemployed. Ask him what he would do if it happened to him.

I hope this comes back to bite your boss. If the Perp can do it once, he will do it again. Who says this is the first tiime anyway? Do you know where he worked previously, and why he left?

Well after 1 And a half days of unemployment, I have scored a job at a Land Rover specialist! Dream job!!! On the second phone call I landed the job! To be fair yesterday I didn't bother I was too busy taking the front axle off my project rover, to anyone who says there's no jobs out there, get off you're ****!
