“It's like getting blood out of a stone”?

Well I need to do that.

My ex business partner still owes me money.

He agreed to pay the balance owed to me in 23 monthly instalments of £400.00.
He still owes me 8 instalments, these being 12 months overdue despite monthly reminders from me.

Not being flush with funds myself I don’t want to spend too much with the legal profession.

Any suggestions?

Failing that you could fab up a letter of intended prosecution in an attempt to scaremonger him.

does he have a business now? You could put a winding up order on him for a few hundred quid. Otherwise its the small claims court, if you have all the paperwork and an agreement from him you will win no problem. Failing that you could go to see my legal hero Judge Judy Laughing

Thanks for the link, looks like the "small courts" as my beard and regular visits to his office hasn't worked Rolling Eyes
I had thought of adding some details of his financial dealings on his Facebook wall but unsure if that would lead my into hot water!

An old boss of mine used to have a set of magnetic signs saying "Patterson Debt Collections"

He would put these on the van when he went to visit people who owed him money - usually to their house rather than their business. He claimed he always got the desired result!

Is it the business or him personally? Businesses can have an abbreviated demand sent to them giving 4 days to pay or you can appoint an administrator.

I would always advise the legal route, it's hard to control things from jail!

go the small claim route , it can cost as little as £25 to put him there . if he fails to pay then he gets black listed and a ccj against him / his company

Was the original agreement for 24 payments in writing? Did you give him/her receipts for the honoured payments? Do you have duplicates of said receipts?

If not you will have a problem with the small claims court.

small claims court, and then if awarded in your favour, you can use the court sheriff service

had dealings with these guys (was owed cash myself ) cost me 120 in amm which I got back and they did the work..

Hi,

Doon on-line Land Registry search on his house (just the register details, not the plan) cost about £4.

That will tell you if which banks have an interest, but not how much. If only one, he should be able to get a second mortgage to pay you. If more than one, think about speeding up your interest, before somebody else does.

Sorry I have not kept up with your suggestions.

Thanks to all.

The debt was his and the agreement was in writing.

I took a final demand letter and presented it personally, with the confirmation that I would be using the "small claims" court to recover the balance if not payed in full within the next seven days.

Put the letter in his hand in the middle of the showroom and reiterated my intentions.

I picked up a cheque from him the next day, banked it immediately and am pleased to say it has now cleared.
