I just won this on ebay:

And the seller is trying to bail, he sent me this when i messaged him to arrange collection:

Hello I don't know what to say to you.
I put this land rover on my ebay for one of my naighbours sons, my wife just popped in to let him know the good news and he informed her that he meant to let us know last week that he had decided not to sell the car now and was keeping it for work, well I was gobsmacked to say the least, I really am so very sorry and I really dont know what else to say to you read my feedback, you will see that I dont do business in this way but there is absolutly nothing I can do about this.

He should have stated he was selling it on someone elses behalf......

Looks like it went too cheap and now theres some serious back paddleing going on.....

Don't really know what you can do except report it to ebay and give him bad feedback.......

I read through some of the ebay rules, and came up with this responce.

But under the rules of ebay, you have a contract of sale with me.

Im very sorry for the hassel this may involve for you, but i have the cash to buy this vehicle and fully intend to collect it this week.

Feel free to contact me with a time and date for collection

I understand that you were selling this for a 3rd party, but i really want this vehicle, and when you sell something on ebay you enter in to legaly binding contract, from which you carnt back out after the end of the auction.

I look forward to your responce, I can come over most days this week.

good luck, i hope you get the LR. i know nothing about the rules on your purchase but a good 90 for 1k is worth fighting for. If he plays silly b*gg*ers vist a lawyer, some will give you a quick consultation for free. I did this once about a builder and learnt so much in 10 mins, I bet for a small fee a very good letter could be posted.

Id let the fellow who owns it know exactly whats happened that he is under contract or so much his friend is, and go from there...

Either the seller is gonna have to stump up the extra dollar to secure the rover for you or face possible fraud charge if you want to take it that far.

nothing being reasonable cant resolve i shouldnt imagine, id take a couple of big lads down with me for good measure though... not cos thats how i do business but you dont know how others do

I wish you all the best... but I suspect you won't get anywhere. The owner will say you have no right to take his 90 because 'he' didn't sell it and never entered into an e-bay contract. The seller will just blame the owner.

Many people on ebay deal in cars on the side, a hint that you have read his feedback and sales and you may need to talk to the VAT man may just sway it in your favour Wink

They dont like unwanted attention ebay car dealers

(things like 'We may be able to Deliver this Vehicle to your door so please email me your post code for a sensible quote.' and that you prefer cash)

You also sold a landy 110 that you said you took in part ex

These things give me the feeling that you may have just have not quite got what you wanted for the truck so would rather not sell it.

If you want I can be there wendsday with cash as asked.

Sorry if I have got this totaly wrong, and please dont take offence, but I need this vehicle.

Speak to EBAY - They are the "seller" and have a responsibility. But I bet they will take the attitude of oh well we will cancel the SALE..... rather than cause trouble.

If you have not yet paid any money then you haven;t lost. But stick to your guns...... Goto the PAPERS / TV etc.

I read somewhere that on most of eBay, a contract is entered into by the seller etc etc so he must sell it to the highest bidder. However, it also said that this doesn't apply to the eBay motors section and that it was designed as a medium to bring a buyer and seller together. I'm not sure whether that's true or not, but I have a feeling it is.

Good luck though, I hope you manage to get him to come up with the goods.

i would get there sooner than latter! he's a dealer theres no doubt so it may get"sold" before you get there to try and get out of it.remember the vat man bit its usually a winner,and point out you missed a couple of others while bidding on his.

also check it over when you get there some people dont like loosing and tamper with things.

OK. An 8 hour round trip for a pile of hassle? Is it really worth it especially as the car may be not what you think once you get there.

Additionally DO NOT SEND HIM ANY MONEY! If you think you've got a bit of hassle now imagine what getting anything back from Paypal will be like as you knew he was a chancer BEFORE you sent a payment.

Neg feedback and walk away with all you cash in your pocket.

thanks for all the help guys, on the offchance I went down to the auctions last night and baged a 2000 reg navara with 7k on the clock for £900!!!!


Its mint.

Apparently no one managed to get there cus of the snow.....
