|
|
|
A toe rag ran into the back of me while I was stationary in traffic. Fortunately no injuries or damage to me or my car, but said toe rag reversed and drove off at speed without attempting to exchange details. I have it all on dashcam, front and rear, and thinking that he drove off possibly because he may not have insurance I reported the incident to the police.
The police are reviewing the matter including the dashcam footage and said they will prosecute if there is evidence that will stand up in court and this will include failing to stop after an accident.
They also said that anything on dashcam that shows me committing an offence would also be subject to prosecution - fair enough.
I had to show my documents; driving licence, insurance, MOT - fair enough.
But here comes the crunch for the oldies. You have to renew your licence when you reach 70 years old if you want to keep driving - it's free and dead easy to do online - but the police person told me that I would be surprised at how many people fail to renew and then when reporting an incident such as mine they find out they don't have a valid licence so they get done for that.
So be sure to renew your licence if needed and if you report anything to the police make sure you are fully legal and if you submit dashcam footage expect to be "nicked" if there is anything on it to put you in the wrong. Remember that your speed is shown on the footage. As for me I was all goodie, goodie legal (oh for the days of youth when you cast caution to the wind!).

You can usually turn off the speed stamp if your concerned about that.
Another note to add is that the renewal of your license is a self declaration that your still fit to drive, however you will lose any entitlements you have to vehicles over 3.5 tonne and that sort of thing unless you take an annual medical. Not sure where you stand with trailers you'd need to look that up...

With free download of video editing software available (and the skills to use it becoming more commonplace) it makes me wonder how long before dash-cam video insurance fraud becomes a "thing"...

Trailers is a bit complicated and it depends on when you passed the relevant driving test. If you passed the test before 19 January 2013 you can tow any sized trailer but if you passed after that date you can only tow a trailer with a MAM of up to 3,500kg.
Best to go to the DVLA website where you can check online to see what categories you can drive. It is personalised to you as there is no blanket entitlement for everyone as it depends on what tests you have taken, your age and when you took the tests.
For me, I can drive anything except trolley buses (haven't seen one of those since the 1950s) although I would have to take the medical if I wanted to drive heavy vehicles (I think of over 12,000kg) and vehicles with more that 16 passenger seats.
You don't need a driving licence for electric bikes, mobility scooters or powered wheelchairs - so there's hope for me yet! Anyone know where I can get a 70mph plus electric bike?

I knew someone who lost their licence due to drinking and driving - he bought himself a mobility scooter to get around and carried on drinking and driving home on the scooter

You can be done for drunk in charge of a - just about everything!
When the DD law first came in a local farmer had a road laid across his field from the back of the pub car park to his farmyard so he didn't have to drive on the roads but curiously he use to drive to the pub on the roads and then drive home via his private road.

I think once your over 70 you have to take a medical to drive anything over 3.5tonnes every time you renew your license (every 3 years?). I think you can carry on with a trailer as you did before but as you say it's complicated... and I'm not old enough to need to worry yet
By the time I'm 70 I'm more likely to be attempting a Logans Run than be worrying about driving legally

The DVLA say for me I can drive up to 12 tonnes without a medical.
Good luck with Logans Run.

To update so far: Recieved a letter from the police RTC (Road Traffic Collision) Process Team to say that the report has now been recieved and giving a reference number. It goes on to say that before a final decision can be made further enquiries are necessary which may take up to six months after which I will be notified of the final decision.

I'll lay odds that a NFA report will be filed. (No Further Action).

So will I. The reason I reported the incident is because I thought the toe rag who ran into me and then drove off probably had no insurance, so a with a two second check on the insurance database Mr Plod could quickly find out.

Nope, nothing happened despite being sent a letter saying that the matter would be dealt within up to 6 months.
You were right, you should have put a tenner on it at the bookies.

I don't believe it!
A year on and it's happened again. Yep, someone bumped into the back of me while I was stationary waiting at traffic lights but this time the other driver did not speed off. Fortnately there appears to be no damage. Again I have it on dashcam but this time there is no reason to doubt if the driver was insured.

That's a real pain! I've tried to do the nice thing before and agree not to go through insurance and often back fires on me so now I just report it and make it someone elses problem.
My grandads retirement job was cutting hedges with a tractor mounted flail mower. He would often have people run into the back of him despite putting warning signs up down the road and being in a tractor covered in flashing lights. Problem was he use to concentrate so hard on getting the hedge right that he didn't notice until he looked behind him to reverse for another pass and there would be a car with no bonnet parked in the road. Every time he used to put in an insurance claim for £70 to repaint the oil tank People just don't seem to look or think very far ahead.

Hi,
Does not a film used in evidence require a sworn statement from whoever was operating the camera. Like ... who was driving at the time of the alleged offence.
Do the police take the same attitude when it's one of their drivers who pulled a random "naughty"?

My local plod say that when a dashcam file is submitted to them they will investigate all suspect things on it and not just the incident reported.

Hi,
My understanding is that photographic evidence has to be supported by a sworn statement by another witness, to confirm that the film is a true account of what occurred.
Speed cameras have to be verified by having a police car drive past at a specified speed ... I think at the start of each day. Google will know
Yes, your dashcam will record what happened, but not who was driving your car at the time.
Lesson learned? Do not give the police access to your dash-cam, no matter how much they beg for witness to a serious crime.
I think speeding one of those offences that require the police to send you a (NIP) Notice of Intended Prosecution within 14 days, but I don't know when the clock starts ticking. The 14b day limit has got something to do with how long you are supposed to be able to remember the incident.
