This obviously isn't the case here, but something which I've thought of before. Chinley Steps being a prime example (Clough in the peaks).

What's the definition of the 'lane'?

There was some really bad off piste driving around the steps on the clough, but.. the driving was between the walls of the fields surrounding the lane.

So technically (from what I believe), although vehicles we not following the established track, they were still driving within the confines of what was classed as the lane.

It's kinda mute point regarding the clough since it's now been TRO'd, but it does raise the point of, when is off piste driving actually off piste? Sections of Strata Florida fall into the same category - the bomb hole there by the river, we've all watched many video of towbars getting caught trying to get out of the hole, and technically it's the lane, but where does good practice come into play and people stick to the defined tracks and not deviate from them? Or are we hard nosed about this and if it's the lane we've a right to drive it, so we will?

Absolutely disgraceful behaviour! I've been going to that general area for the last 18yrs (although not for the last 18mths) and the general standard of behaviour has deteriorated in the last three years or so. What Dave's shown in his photos is one of the reasons why I've called it a day. I definitely do NOT wish to be associated with prize jackasses!

It is sickening and it is pitful and it's also too frequent, we were in the Lakes the other week and there was balatant evidence of off piste driving at the top of Parkamoor, as if Parkamoor isn't a good enough lane to drive up the rock sections, some morons have to drive up a hill that is just not that much of a hill and make a complete mess of the ground. For the most part I think it's half wits that go to the auctions and buy any old shed of a 4WD and take it out when and where they want until they're bored and then sell it and buy whippets or budgies or whatever the next craze is, but how do you stop that.

We drove this 'lane (Roych Clough) and have seen the deviations from the actual RoW (up the rock step at the time) as users obviously took the "easy route" around it, but that is by definition leaving the RoW?

The same on the Wayfarer, there was a particularly deep water trough, so users deviated from the actual RoW to take an easier route round it, again leaving the RoW to take the easier route...

It's my belief that if you and your truck are not equipped to follow the actual RoW without deviating from it, then you should NOT vary from the defined RoW but go back the way you came, and NOT take an easier route around the obstacle (rock step / water trough) that you / your vehicle can not surmount...

But that's just my opinion and definition...

You wouldn't / shouldn't drive on the pavement to avoid a pot hole on a tarmac road for instance, you would stay on the tarmac road and do your best to get through the pot hole without further damage to the road or your vehicle, for instance? Perhaps a bad analogy?

I totally agree, but the damage you saw, that was still technically the lane (iirc speaking with officer at the time...)

Maybe the analogy would be, you see a pothole on the inside lane of a motorway, do you stop or do you pull over to the next lane?

Don't get me wrong, I'm playing devils advocate here.

I'd agree with this. Funnily enough, this is what started the problem on the Hero years ago, when various convoys started going up there with under equipped vehicles. They couldn't handle the ruts of the track in the problem field, so drove on the field itself, much to the annoyance of the farmer / owner. So he began to wait up there at the weekend to tell them to stay on the track, which caused several altercations, and things escalated from there.
I never had any difficulties with him, mainly because my motor stayed on the track, and I agreed with him that those vehicles should not be coming up there, especially as I knew they were having problems further on. I'm afraid that my attempts to get the Council to carry out repairs were unsuccessful.
I don't know whether the old boy I used to meet is still about, but I'd imagine his family share his opinions, and I can't really disagree with them.
If there is legal action pending, I'd certainly be interested in the outcome, even though I no longer venture onto the lanes.

I used to take a disabled person into the countryside in a Disco as it was the only way that person, and many others, could access the countryside - that is until the Ramblers get the few greenlanes that were suitable TROed.

The Ramblers Association must be the most self centred and selfish, and now hypocritical organisation ever. It is sickening to see them claiming to want access to the countryside for all when they have deliberately and selfishly done everything possible to excude so many including some of the more disabled members of society.
