That is certainly not the case in England and Wales, and I would like to see the proof of that in Scotland.

Again, context and intention. If my appearance in the photo were incidental eg a photo of pretty landscape with me working away oblivious taken for the pleasure of a nice photo - fine, the same photo taken for the purpose of tracking my activity on my property - invasion of privacy. The issue with CCTV and photographs is very complicated with some parts covered by the Human Rights Act 1998 (HRA) other parts by Regulation of Investigatory Powers Act (RIPA) and others depending on the situation. Article 8 of HRA states "Everyone has the right to respect for his private and family life, his home and his correspondence" and it is this phrase that allows possible prosecution for such intrusions.

The Police will apply 'common sense' to complaints about CCTV. Where a works yard has private CCTV that covers the yard but the sweep also takes in private property nearby, the owners could face prosecution if they refuse to alter the sweep to cover only their yard unless they seek the permission of those also being covered. I would assume that this really applies to peoples gardens and windows. One case locally last year had a row of terraced houses with an ongoing anti-social behaviour problem with drunks from a local pub peeing and vomiting in their gardens. The house at the end put up a camera and offered to cover the entire row of 5 houses. Had one of the middle houses had refused then the camera could only cover their own garden and in any case it cannot cover the public highway except incidentally.

Signage, interestingly enough is not always required. For private homes, like mine, where cctv is for 'personal' protection of property and only their own land is covered no signs are needed. Most of these 'rules' are for recorded images only.

As with taking pictures of accidents, there are so many variables it is impossible to have a single set of rules that anyone can make sense of so the general approach by Authorities over private CCTV and images of individuals taken by individuals is to examine intent on a case by case basis. My neighbours, who have spent years monitoring and recording my activities, are now painfully aware of the illegality of their actions and the ongoing risk of prosecution should they continue. The Police have seen my CCTV and whilst movement on the road can be seen it is regarded as acceptable collateral intrusion to allow me to see people/cars entering my driveway (more of a large yard really) from the public road. No one's private property (apart from mine) can be seen and my intention is obviously reasonable.

The 'Data Protection Act' might well be the important thing when Publishing or making openly available photographs or images these days.

Hi,

Does anybody remember a newspaper photo of a stowaway on an air liner?

He had hidden himself in rhe wheel bay in the wing ... not realising that the bit he was sitting on was lowered after take-off, so the wheel could be retracted. Some "lucky" photographer pointed his camera at the ascending plane, managed to snap the unlucky stowaway several feet below the plane..

Sick .... but lucrative .... and I doubt that the stowaway complained.

Where can I buy a burka?

There was a ludicrous case here not long ago where a Minister photographed some young scroats stealing the lead off the Church roof and he was warned he could be prosecuted!

I would have said "see you in Court". I'd like to see him actually get convicted and of what! By which I mean I'd like to see them try rather than I want to see the man in Court!

Pics of everyones houses on the web and cars etc...?


I have plenty of pics of offroad mishaps but these are generally accepted as laughing fodder for the masses.

I can only reitterate that the pic I took was of the roof cut off and no-one at the scene of the accident from avout 80-100 meters away,

yes it does and many people dislike it for privacy reasons, however faces are blurred out (although you can recognise some if you know who they are) and the purpose is not the invasion of privacy unlike my neighbours monitoring my activities using video and still photos for them to keep in case they want to have a go at me months or years later.

I once got extremely annoyed at someone when our car had been involved in an accident while it was parked,thankfully we had just got out of the car when the incident happened but the car was a right mess after being sandwiched,anyone seeing the wreckage would have assumed anyone in the car had been seriously hurt or worse.

When we finally got home after seeing to people from the other 3 cars involved and having the car recovered etc I got a call from a worried family member that was beside herself with worry because she had seen the photos before hearing from us.
